Planning work involving a Party Wall?

Carrying out works that involve the Party Wall Act can be complicated. With all kinds of legalities and regulations to abide by, it’s always best to get expert help.

Are you the Building Owner?
You are obliged to give your neighbours formal notice, typically 1-2 months depending on the works involved.
Why use Home Approved?
While you can issue notices yourself, you’ll need a surveyor to ensure full compliance. Home Approved will work to protect your interests, minimise dispute risk and keep your project on track.
Are you the Adjoining Owner?
If your neighbour is doing works that affects your property, there is a statutory process designed to protect your interests. If you receive a Party Wall Notice, you must respond within 14 days. If you don’t, a dispute is automatically deemed to have arisen.
Why use Home Approved?
You have the right to appoint your own surveyor to ensure the works are carried out in accordance with the Party Wall Act. The good news is the building owner carrying out the works is generally responsible for covering the costs of your surveyor.

About The Party Wall Act
Your building work may fall within the Party Wall etc Act 1996 if…

You’re going to build on or at the boundary with another property.

You’re planning to carry out work on a wall, ceiling or floor structure shared with a neighbouring property.

You need to excavate ground near one or more neighbouring properties.
Serving the correct notice(s) on your neighbours
Party Wall Notices
If your work is notifiable under the act, this means you’ll need to serve the correct notice(s) on your neighbour(s) and it may be necessary to have a Party Wall Award in place before the work can proceed.
We can prepare notice(s) and make contact with the adjoining owner(s) and deal directly with them on your behalf.
What next?
If a neighbour consents to the notifiable works, this eliminates the need for an Award to be served and work can commence.
If there is no consent, a dispute is triggered. This then require the services of one or more surveyors to draw up a Party Wall Award which will resolve the dispute and enable the works to go ahead.
